1. Agreement to Terms

Welcome to Sanatani 🙏. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Sanatani App ("we," "us," or "our") governing your access to and use of the Sanatani mobile application (the "App").

BY DOWNLOADING, INSTALLING, OR USING THE APP, YOU AGREE TO BE BOUND BY THESE TERMS. If you do not agree to these Terms, please do not use the App.

2. Description of Service

Sanatani is a community safety application designed for members of the Sanatani community. The App provides:

• Real-time Location Sharing: View nearby community members on a map
• Emergency SOS Alerts: Send and receive emergency distress signals
• Push Notifications: Receive critical safety alerts
• Community Connection: Connect with nearby Sanatani community members

3. Eligibility

To use the App, you must:

• Be at least 13 years of age
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the App under applicable laws
• Provide accurate and complete registration information
• Maintain an active email address and phone number

By using the App, you represent and warrant that you meet these eligibility requirements.

4. Account Registration and Security

4.1 Account Creation

To use the App, you must create an account by providing:

• Full name
• Valid email address
• Phone number
• Secure password

4.2 Account Responsibility

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring your account information is accurate and up-to-date

4.3 Account Termination

We reserve the right to suspend or terminate your account if:

• You violate these Terms
• You provide false or misleading information
• You engage in fraudulent or illegal activity
• Your account poses a security risk
• We are required to do so by law

5. User Conduct Important

You agree to use the App responsibly and in compliance with all applicable laws. You shall NOT:

5.1 Prohibited Activities

• Send false or fraudulent SOS alerts
• Harass, abuse, or threaten other users
• Use the App for any illegal or unauthorized purpose
• Impersonate another person or entity
• Interfere with or disrupt the App's functionality
• Attempt to gain unauthorized access to the App or its systems
• Use automated systems (bots, scrapers) to access the App
• Reverse engineer, decompile, or disassemble the App
• Remove or modify any copyright or proprietary notices
• Share your account credentials with others

5.2 False SOS Alerts

5.3 Respectful Communication

When interacting with other users, you must:

• Treat all community members with respect and dignity
• Refrain from discrimination based on race, religion, gender, or any protected characteristic
• Avoid offensive, abusive, or threatening language
• Respect others' privacy and personal boundaries

6. Location Services and Privacy

6.1 Continuous Location Tracking

By using the App, you explicitly consent to continuous collection of your precise GPS location data, even when the App is running in the background or closed. This is essential for:

• Displaying your location to nearby users
• Calculating distances between users
• Enabling emergency SOS functionality
• Showing SOS alerts from nearby users

6.2 Location Visibility

Your real-time location is visible to:

• All users within a configured radius (default: 10 km)
• Users who receive your SOS alerts

You acknowledge and accept that your location is shared with other users as a core feature of the App.

6.3 Location Permissions

Revoking location permissions will prevent the App from functioning properly. The App requires "Allow all the time" location access to work correctly.

7. SOS Alerts and Emergency Features

7.1 SOS Alert Functionality

The SOS alert feature allows you to:

• Send emergency distress signals to nearby users
• Include your current location and optional message
• Receive notifications when others respond
• Cancel alerts when the situation is resolved

7.2 Response to SOS Alerts

When you receive an SOS alert from another user:

• You are not legally obligated to respond
• Responding is entirely voluntary
• You should prioritize your own safety
• Contact local emergency services if appropriate
• Use your best judgment before physically going to the location

7.3 No Guarantee of Response

8. Intellectual Property Rights

8.1 Ownership

All content, features, and functionality of the App, including but not limited to:

• Software code and architecture
• User interface designs
• Graphics, logos, and trademarks
• Text, images, and multimedia content
• Databases and data compilations

are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms.

8.3 Restrictions

You may NOT:

• Copy, modify, or distribute the App
• Reverse engineer or attempt to extract source code
• Create derivative works based on the App
• Use the App for commercial purposes without permission
• Remove or alter any proprietary notices

9. Disclaimers and Limitations of Liability

9.1 "AS IS" Basis

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy, reliability, or completeness
• Uninterrupted or error-free operation

9.2 No Liability for User Actions

We are NOT responsible for:

• Actions or inactions of users responding to SOS alerts
• Harm resulting from reliance on the App
• Failure of users to respond to SOS alerts
• False or fraudulent SOS alerts created by users
• Damage or injury resulting from user conduct
• Loss of data due to technical failures

9.3 Limitation of Liability

10. Indemnification

You agree to indemnify, defend, and hold harmless Sanatani App, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

• Your violation of these Terms
• Your use of the App
• Your violation of any rights of another user
• Your violation of applicable laws or regulations
• Any false SOS alerts you create
• Any harm resulting from your actions or inactions

11. Third-Party Services

The App integrates with third-party services including:

• Google Maps: For map display and navigation
• Firebase: For push notifications and analytics

Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for any third-party services or their actions.

12. Modifications to Terms and Service

12.1 Changes to Terms

We reserve the right to modify these Terms at any time. When we make changes:

• We will update the "Last Updated" date
• Significant changes will be notified via in-app notification or email
• Your continued use after changes constitutes acceptance

12.2 Changes to App

We may modify, suspend, or discontinue the App or any features at any time without liability to you.

13. Termination

13.1 Your Right to Terminate

You may delete your account at any time through the App settings or by contacting us.

13.2 Our Right to Terminate

We may suspend or terminate your account immediately, without notice, if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• Your account poses a security risk
• We are required to do so by law
• We decide to discontinue the App

13.3 Effect of Termination

Upon termination:

• Your right to use the App immediately ceases
• We may delete your account data (subject to our Privacy Policy)
• Provisions of these Terms that should survive will continue to apply

14. Governing Law and Dispute Resolution

14.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

14.2 Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through:

1. Informal Resolution: Contact us first to attempt to resolve the dispute informally
2. Mediation: If informal resolution fails, disputes may be submitted to mediation
3. Binding Arbitration: Unresolved disputes shall be settled by binding arbitration

14.3 Class Action Waiver

You agree to resolve disputes on an individual basis only and waive any right to participate in class actions or class arbitrations.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App.

15.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

15.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms at any time without notice.

15.5 No Agency

No agency, partnership, joint venture, or employment relationship is created between you and us as a result of these Terms or your use of the App.
